Reed was decided today (or yesterday, whatevs), a case in which anti-gay activists in Washington State failed to argue that releasing the names of petitioners behind an ballot measure against gay partnership benefits would violate their first amendment rights. The decision doesn't have much impact—it mostly comes down to states rights, though Scalia did get to call the plaintiffs a bunch of pussies—but I think the premise does. The whole basis of the challenge was that those who signed the petition would be subject to discrimination, having been revealed as opposing an extension of the benefits of marriage to gay and lesbian couples. And besides, R-71 ended up confirming the domestic partnership law 53-47.
There's still a long way to go, but I see some progress in there being a fear of being seen as a bigot, and in Justice fucking Scalia thinking you're a coward for expecting hateful speech, though free, to be free of consequence. Things still suck, I agree, but things are getting better. Have hope.
